These Terms of Service (“Terms”) govern your access to and use of the services provided by Investor KITAS Indonesia, operating under Juara Holding (hereinafter referred to as “Investor KITAS Indonesia,” “we,” “us,” or “our”), through our website investorkitas.com and any associated platforms. Investor KITAS Indonesia specializes in providing expert consulting, advisory, and administrative support services to assist eligible foreign investors in navigating the complex process of obtaining an Investor KITAS (Limited Stay Permit) in the Republic of Indonesia. Our mission is to simplify this journey for you by offering comprehensive guidance and facilitation.
2. Scope of Service and Disclaimers
Investor KITAS Indonesia offers a range of services including, but not limited to, initial consultations, eligibility assessments, document preparation assistance, application submission guidance, communication facilitation with relevant government authorities, and updates on application status. Our services are designed to facilitate your application process efficiently and accurately.
Crucial Disclaimer: Investor KITAS Indonesia acts solely as a facilitator and consultant. We do not issue visas, permits, or make any decisions regarding immigration applications. All approvals, rejections, processing times, and specific requirements are solely at the discretion of the relevant Indonesian government authorities (e.g., Directorate General of Immigration, Ministry of Investment, Ministry of Law and Human Rights). We cannot and do not guarantee the approval of any visa or permit application. Our role is to provide professional assistance and guidance based on current regulations and our expertise.
You acknowledge and agree that:
- We rely on the accuracy and completeness of the information and documents you provide. Any inaccuracies or omissions may lead to delays or rejection of your application, for which we bear no responsibility.
- Government regulations, policies, and fees are subject to change without prior notice. While we strive to provide the most up-to-date information, we are not liable for changes made by government bodies.
- Processing times provided are estimates only and are subject to change by government authorities. We are not responsible for delays caused by government processing, public holidays, or unforeseen circumstances.
3. Client Responsibilities
As a client, you are responsible for:
- Providing accurate, complete, and truthful information and all required documents in a timely manner.
- Complying with all requests from Investor KITAS Indonesia and Indonesian government authorities.
- Attending any required interviews or appointments with government officials.
- Adhering to all Indonesian laws and regulations throughout the application process and during your stay in Indonesia.
- Reviewing all documents prepared by us on your behalf for accuracy before submission.
4. Fees and Payment
Fees for our consulting and facilitation services are quoted on a case-by-case basis, depending on the complexity and scope of the services required. Our fees are separate from and do not include any government application fees, official duties, levies, or third-party costs (e.g., translation services, notarization, courier services), which you will be responsible for directly or will be charged separately as disbursements.
Payment terms, including upfront payments, installment plans, and accepted payment methods, will be communicated to you prior to engagement. All fees are typically denominated in Indonesian Rupiah (IDR) or United States Dollars (USD) and are exclusive of any applicable taxes (e.g., VAT), which will be added where legally required.
Services will commence upon receipt of the agreed-upon payment or initial deposit.
5. Refund Policy
All fees paid to Investor KITAS Indonesia for our services are generally non-refundable, except as explicitly stated in our separate and detailed Refund Policy. Clients are strongly encouraged to review the full Refund Policy, which is available upon request and will be provided to you prior to engaging our services. This policy outlines specific conditions under which a refund, partial or full, may be considered, such as service cancellation prior to commencement or specific failures on our part. Government fees and third-party costs are typically non-refundable once paid to the respective entities.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Investor KITAS Indonesia, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; (iii) any content obtained from the services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
